Products liability law is one of the strongest tools available to an injured rider. Under the doctrine of strict liability, you do not have to prove that the manufacturer was negligent. You have to prove that the product was defective when it left the manufacturer, that the defect caused your injury, and that you were using the product in a reasonably foreseeable way. Every entity in the chain of distribution — the maker, the importer, the distributor, and the retailer — is jointly and severally liable.

What you need to understand

The three types of defect that drive these cases

Manufacturing defect: the product was supposed to meet a spec, and the specific unit you got did not. A frame weld that was missed by quality control. A brake-lever pivot pin installed without its retaining clip. A battery pack with one cell from a different production lot than the others.

Design defect: the product met its spec, but the spec itself was unreasonably dangerous. A throttle that can latch in the on position. A controller with no over-current protection. A folding mechanism that can unfold under rider weight.

Failure-to-warn: the product was made and designed correctly, but the manufacturer failed to give the rider an adequate warning about a non-obvious hazard. The classic e-bike example: failing to clearly warn that the bike's original charger cannot be swapped for a higher-voltage charger, even if it physically plugs in.

Why direct-to-consumer brands are especially exposed

Many of the newer e-bike brands skip the traditional dealer network entirely. They import from a single Chinese contract manufacturer, brand the bikes themselves, and ship direct to consumer. That model has cost advantages — and serious liability exposure. There is no dealer service network to catch a recalled component. The warranty is administered by a brand with no engineering staff. The importer of record is often a single-purpose LLC with thin assets.

In practice this means that a successful claim often has to reach upstream — to the actual contract manufacturer in Shenzhen — or sideways, to the platform that hosted the listing. Both paths exist, and both have produced recoveries. Neither happens by accident.

Recalls do not erase liability — they confirm it

If your bike is on an active CPSC recall and you were injured by the recalled component, the recall itself is admissible evidence that the defect existed and the manufacturer knew it. The defense will argue that you were on notice once the recall was issued and should have stopped riding. That defense usually fails when the brand never directly notified the original purchaser — which is the rule, not the exception, for direct-to-consumer brands with no registration database.
